The suspect in Tupac Shakur’s murder, Duane “Keffe D” Davis, is seeking to have the charge dismissed. Davis’ attorney stated that a motion to dismiss the indictment has been filed. The argument is that the prosecution’s delay and a prior grant of immunity violate Davis’ constitutional rights. The motion was filed on Monday, January 6, 2025. Davis claims he was granted immunity after confessing his involvement during a 2008 investigation.

Davis has been behind bars since 2023 and was known as a Crip gang leader. Carl Arnold, Davis’ lawyer, stated that the prosecution failed to justify a decades-long delay, which has significantly affected Davis. Arnold further argued that this failure undermines the integrity of the criminal justice system.

Prosecutor Marc DiGiacomo presented compelling evidence, claiming that Duane Keffe D Davis fired the shot that killed Shakur. Davis denies the evidence and has pleaded not guilty to first-degree murder. The trial is still scheduled for March 17, 2025.

The murder occurred 28 years ago, on September 7, 1996, in Las Vegas, Nevada. At the time, Suge Knight was driving with Tupac Shakur through the streets of Las Vegas. A drive-by shooting took place when their car stopped at a red light on East Flamingo Road.

Shakur was shot four times, sustaining serious injuries. Knight quickly drove away from the scene and alerted a bike patrol for assistance. Both Shakur and Knight were transported to the University Medical Center of Southern Nevada.
